The Many Faces of Cheaters

You caught your husband/wife cheating.  Now what?  You have two options.  Leave or stay.I hate to boil it down to such a simplistic statement because I recognize the frustration, confrontation, anger, disappointment, hurt, fear and even sometimes violence that results. The emotions of being betrayed are intense and heart wrenching.  What follows discovery of the cheating is either an admission of guilt or denial of same; then there is the blame game.  Or making light of a serious situation. Or remorse and apologies followed by useless promises.  No matter how you look at it, cheating causes marital trouble.

But here’s the big punch:  I am not just talking about cheating as being extra marital sex, adultery, affairs, or romances.  In addition to sex cheating, I am also talking about financial cheating; food cheating; chores cheating; gambling cheating; emotional cheating; alcohol or drugs cheating.  Think about it for a minute.  Some marriages have more than one!

These many faces of cheating can have serious and disastrous effects on a marriage.  Things like financial ruin,broken trust, abandonment, domestic violence.

Not Obeying Court Orders

If you are divorced, you have a court order that either directs you or your spouse to perform certain obligations. This can be the payment of child support and/or alimony, making mortgage or rent payments,  executing a quit claim deed, or transferring property or other tasks.

If you are charged with the obligation, and willfully do not do what you are supposed to do, you may suffer the consequences of contempt of court, that being substantial fines or incarceration.

If you are the recipient, and you do not receive what you are entitled to under the court order, it is up to you to take affirmative legal action by filing a motion for enforcement or contempt.

Liars, and Cheaters and Fraud…Oh My!

I once heard a divorce court judge address a courtroom full of lawyers, husbands and wives, court reporters and spectators, and what he said will never leave my memory…he said something to the effect that, this is divorce court.. everyone is lying.

Appraisers can place valuations of heirlooms to real estate to benefit the party who hires them…accountants can make the numbers say anything they want to…lawyers can interpret statutes and case law from their ownone sided  perspectives…financial affidavits of husbands and wives generally and regretably leave something off the asset column.  One can conclude divorce court is not an exact science.

So how do you reconcile the difficulties of litigation?  The first and best answer is to stay out of court.  At least in settlement talks the parties can determine their own destinies, like it or not.  The next best step is zealous advocacy.  Hire professionals who really on are your side and are dedicated to doing the best job possible for you.  This includes the accountant, the lawyer, the appraiser, the shrink, and private eye and anyone else you need to rely upon for zealous advocacy.

Lastly, you must not have personality conflicts involved in your case.  If you are not comfortable with your “team” do something about it before it is too late.  You can always change attorneys, CPAs, shrinks, etc.

What Is Temporary Relief In Divorce Actions In Florida?

Temporary relief can be obtained by agreement of the parties that is reduced to a court order, or by a mini trial before the judge in Palm Beach County Family Court.  The issues to be decided in temporary relief are primarily support and time sharing with children.  Support includes temporary alimony and child support, especially if a spouse has cut you off.   Division of assets and debts is not generally a temporary relief issue unless marital assets need to be partially distributed to pay the attorneys.

Temporary relief is a mini trial that occurs AFTER a mediation in an attempt to settle the issues of temporary support and time sharing.  Child support, alimony, time sharing and attorneys fees are the main temporary relief issues.  Other temporary relief issues can include who pays for which household bills, credit cards,  and medical expenses and insurance during the divorce proceedings.

Main Breadwinner Should Keep Status Quo In Divorce Proceedings

By filing for divorce, changes are imminent.  However, after filing, if the husband and wife are still living together, and there is one party who is the main breadwinner of the family, it is wise for that spouse to keep the status quo in terms of bill paying.

In other words, if there is a doctor/husband, and a stay at home wife/mother, the husband should continue to pay what he has in the past, i.e. mortgage, health insurance, household bills, car payments, whatever.

If the major breadwinner of the family cuts the family off financially, should the matter get before a judge, the judge will see the spouse as a wrongdoer…and will award the other spouse temporary relief pending the proceedings.

Abuse and Divorce…You Don’t Have To Take It Anymore

Abuse comes in many forms:  physical abuse can be sexual, violence, imprisonment.  The courts recognize domestic violence and repeat domestic violence and upon proper claim, will remove the spouse from the home.

Abuse can also by psychological: taking away the car keys, cell phone, money,  children.  Courts recognize psychological abuse and will issue court orders to protect you upon presentation of proper evidence and testimony.
If you find you are the victim of either type of spousal abuse, your ultimate recourse is divorce.  You don’t have to live your life this way any more.   Either the husband or the wife can be a victim.  The best advice is to do something about it.
