You caught your husband/wife cheating.  Now what?  You have two options.  Leave or stay.I hate to boil it down to such a simplistic statement because I recognize the frustration, confrontation, anger, disappointment, hurt, fear and even sometimes violence that results. The emotions of being betrayed are intense and heart wrenching.  What follows discovery of the cheating is either an admission of guilt or denial of same; then there is the blame game.  Or making light of a serious situation. Or remorse and apologies followed by useless promises.  No matter how you look at it, cheating causes marital trouble.

But here’s the big punch:  I am not just talking about cheating as being extra marital sex, adultery, affairs, or romances.  In addition to sex cheating, I am also talking about financial cheating; food cheating; chores cheating; gambling cheating; emotional cheating; alcohol or drugs cheating.  Think about it for a minute.  Some marriages have more than one!

These many faces of cheating can have serious and disastrous effects on a marriage.  Things like financial ruin,broken trust, abandonment, domestic violence.

Your spouse may be getting you deeper into debt without your knowledge or permission!  You know about your mortgage, your HELOC, college tuition and the like.  But what you may not know can be harmful to your personal financial health.

Valentine’s Day A Sad Day For Those In Bad Marriage Or Love Relationship!

Chocolates, flowers, jewelry…ahhh Hollywood…If you are in a bad marriage or love relationship this Valentine’s Day,  know that other people are too.  Look around a roomful of married couples and at least half of those marrieds are headed to divorce court at some point.  Current statistics show that 51% of first marriages end in divorce, and it gets much, much higher for second and third marriages. 

Going to a restaurant or country club with your spouse for a romantic Valentine’s Day?  Half of those couples you will see are not having sex tonight.  They may look celebratory and happy, but truth is, marriages are failing all around you whether you know it or not.  In my practice, I see couples who have not had sex in YEARS.

Criminal Law, Tort Law Sometimes Overlap With Divorce Law

In my divorce cases, it is not uncommon to have to deal with additional issues other than those directly effected by divorce law.  Divorce law encompasses alimony, child support, child time sharing, shared parental responsibility, division of marital assets and debts, and what is income of the parties, and what is non marital.

A Divorce Can Jump Start Your Life

A divorce can and often does jump start your life…instead of looking at a divorce as a failure, as many have a tendency to do, look at divorce as a positive beginning.  You are taking an affirmative step to get out of a bad situation.  Divorce can be like bankruptcy…a reorganization of your life. 

Here’s what you will need during or after your divorce:

1.  Do some estate planning and eliminate your spouse from your will, trusts and other estate planning documents.

2.  Reevaluate your life, health, accident, disability, car and long term care insurances.

3.  Get some tax advice either during divorce settlement talks or immediately thereafter.

4.  Same for financial advice…what to do with your settlement funds.

5.  If you want to go back to school or to work, seek the advice of a vocational counselor.  This is a must if you are asking for rehabilitative alimony and a must if you are planning a professional future that you don’t already have.

6.  See what your real estate investments are really worth to you… evaluate a refinancing or a purchase or a sale, or even becoming a landlord by renting out your property.

7.  Get yourself some psychological counseling.  This will help you with the transition from married to single.

Divorce, Foreclosure, Bankruptcy…it’s a new year, a new you.

This past year saw gas prices at an all time high, residential construction and housing at an all time low; builders, decorators, mortgage brokers, real estate agents, roofers, pool companies, car dealers/salesmen, and lots of others all out of customers and out of work.   Not to mention what has happened on Wall Street, and to our retirement portfolios. 

So it is not surprising that my law practice has seen more clients go through more divorces, foreclosures, and bankruptcies than ever before.  People have problems and stress.  If husbands and wives are relentlessly fighting (usually over money), relief is sought by divorce.  If the mortgage (or car payment) can’t be paid, the bank will relieve you of that obligation by foreclosing.  If you are seriously in debt, having run up those credit cards, bankruptcy is your recourse. 

While the picture is not pretty, neither was Year 2008.   It is time to plan for the future.   While I am hardly a doomsayer, I just throw out those three words: divorce, foreclosure, bankruptcy, as real legal options.  You have options.  And with options comes hope for a brand new beginning.
