When You Realize It’s OVER

When you finally come to the conclusion that your marriage is all but over, it is time to invest in a photo copying machine.  You are going to need it for your own protection.  You will have to start photocopying everything you can get your hands on from mortgage payments to tax returns.  Here is a beginner’s list:

1.  ANY evidence of income of either party from whatever source.

2.  Title documents for cars, boats, jewelry purchases, artwork, real estate.

3.  Insurance documents of any kind, including health, life, homeowners, additional riders.

4.  Bank account statements from whatever source (banks, brokerage firms, lenders)

5.  Retirement account statements.

6.  Social security or other benefit payouts including stock options.

7.  A list of what each party came into the marriage with.

8.  A list of what each party inherited during the marriage.

And this is just for starters.  In any divorce action, you and your spouse will need to fill out a financial affidavit and produce mandatory disclosure documents to back up your claims.  You may want to find a couple of empty cartons to put all this paper into and deliver it immediately to your divorce lawyer’s office, before your spouse steals it out of the trunk of your car.  Yes, divorce is a nasty business. PLANNING YOUR DIVORCE for the new year.

If you are unhappy in your marriage, but are not sure what to do, chances are you will stick it out as a family until after the holidays.  BUT NOW is a good time to plan your exit strategy.  While your spouse is out shopping with the kids, or visiting Mom’s house, start photocopying everything you can get your hands on:  income statements, pay stubs, credit card bills, bank statements, loan documents, mortgage papers, retirement accounts, real estate listing agreements, titles to cars, boats, trucks, household expense accounts, investment statements, everything that will show ASSETS, DEBTS, OR INCOME.

Divorce planning is important because it helps you sort out the details of your marriage…this is useful when you go to the lawyer for the consultation.  It gives everyone a better idea of what is at stake and what the issues are to be addressed.

Preparing for Divorce…what should you do?

You have made the decision to divorce.  What happens next?  There are certain steps you may want to take in preparation for a divorce.  Below is a check list:

1.  Know the family finances.

2.  Photocopy and photograph everything.

3.  Have a friend, neighbor, relative or attorney store your papers, premarital possessions, jewelry.

4.  Get your own cell phone.

5.  Hide the car keys, boat keys, airplane keys, keys to your office.

6.  Get a post office box or use a friend, neighbor, relative , your place of business or attorney to receive all your mail.

7.  Get your own computer account.

8.  Change passwords.

9.  Set up credit cards in your name only.

10.  If you have extra cash, pay off marital debt.

11.  Sign a lease or purchase another home if you are the one moving out.

12.  Don’t sign anything your spouse puts in front of you including tax returns without your lawyers or accountants seeing it.

13.  Hire an attorney before you do anything on this list because every case is different.
