Occasionally I have a client come into my office who is in their 70s or 80s seeking to divorce their spouse. I often wonder why. If you have lived this long together, why divorce now? Seniors have several reasons unique to the age group…one may be to escape the financial burdens that aging and poor health cause in a marriage.
Another reason is quite common unfortunately, in that the spouse may have fallen in lust with a younger version of same. Seniors are very active these days at the gym and on the golf course.
A third reason for senior divorce is the party’s children…they want to protect mom or dad from the second or third spouse who is in the marriage just for the money or the lifestyle. Adult children don’t want to see their senior parent taken advantage of in their old age. They also want to preserve the parent’s wealth for own inheritence.
I predict that senior divorce will be more common as the baby boomer generation ages. Along with the aging of America, there are special circumstances to consider when divorcing elder couples, such as living arrangements, health care and estate planning.
